Calculating Child Support in Las Vegas

Helping You Ensure Accurate Child Support Payments

One of the most difficult areas of divorce is that of child support. As a custodial parent, you want to make sure that you receive the support your child deserves. On the other hand, you may be the non-custodial parent and want to make sure you aren't required to pay more than you should. Nevada has strict regulations for calculating child support so that parents can receive and pay only what is fair. It is still beneficial to retain a Las Vegas divorce lawyer, however, to ensure that no mistakes are made in calculating child support for your particular case.

Nevada's Formula for Child Support

Primary Physical Custody

In primary physical custody cases where one parent has custody of the child, the child support amount is as follows:

  • One child – 18% of gross monthly income
  • Two children - 25% of gross monthly income
  • Three children - 29% of gross monthly income
  • Four children - 31% of gross monthly income
  • Five or more children – A 2% increase for each additional child above four

For calculation purposes, "gross monthly income" includes monthly salary, consistent overtime, self-employment, and imputed income.

Joint Physical Custody

Joint physical custody cases are more complex. First, the amount each parent would pay under primary custody cases must be calculated. Next, the difference between the two amounts must be determined by subtracting the lower amount from the higher amount. The higher income parent must then pay the lower income parent the amount determined by such subtraction, up to a presumptive maximum. The presumptive maximum child support payments for Nevada are:

  • Income of $0 - $4,234: Payment of $621
  • Income of $4,235 - $6,350: Payment of $683
  • Income of $6,351 - $8,456: Payment of $747
  • Income of $8,457 - $10,584: Payment of $807
  • Income of $10,585 - $12,700: Payment of $870
  • Income of $12,701 - $14,815: Payment of $931
  • Income of $14,816 – No limit: Payment of $995
