Qualifications for Adoption in Nevada

To qualify for an adoption, you must meet the following criteria:

  • You must be able to provide a loving and safe environment for the child.
  • You must be at least 21 years of age, and at least 10 years older than the child you wish to adopt.
  • There is no requirement to be married.
  • There are training sessions that add up to 30 hours that you must attend.
  • You must have sufficient income.

How Do I Adopt a Child in Nevada?

There are numerous steps in the adoption process and it is extremely beneficial to have help from an attorney who is familiar with them.

The following is a list of steps that need to be taken when looking to extend your family:

  • Get informed and become familiar with the adoption process by researching and reading about it.
  • Fill out all of the necessary court forms; it is helpful to have a lawyer to assist you through these.
  • Get the forms reviewed to make sure they are properly completed; otherwise, it can slow the process down later on.
  • Make copies of your forms (at least 2 copies).
  • File the forms with the court.
  • In order to let the birth parent know about the adoption, you must serve them your papers, which is an Adoption Request form. Someone else must serve them your papers, though; you cannot do it yourself.
  • It is important to talk to the child about the adoption and, if he or she is 12 or older, the child has to agree to the adoption or else the judge will not finalize it. This is not necessary for children under the age of 12.
  • You have to get the consent of the other birth parent; however, if the other parent does not agree, there are still ways that you may be able to adopt, such as if the parent abandoned their child for over a year or the judge decides that the adoption is what is in the best interest of the child.
  • Go through the interview and investigation process, where an investigator will write a report about what they see and file it with the court.
  • Get your court date for the hearing.
  • Attend your hearing in the court and make sure to bring all of the forms you have filled out and the child has to attend as well.
