What Are The Grounds for Divorce?

In some cases, both spouses agree that they want a divorce, and resolve all issues prior to filing. When spouses are not in agreement, the spouse initiating the divorce must declare a cause of action. There are three different types of grounds for divorce in the State of Nevada, according to NRS 125.005. The first is incompatibility, which means that the couple no longer wishes to live together and/or remain married. Insanity existing for 2 years prior to the start of a marriage is also grounds for a divorce. A court cannot rule a defendant insane unless suitable proof is presented to the court.

Mental illness and mental incompetence are examples of insanity, and a spouse must prove that the defendant's insanity is declared, incurable, or both. They must also prove that the condition has lasted for a number of years prior to the divorce filing. The person who successfully proves that the defendant is insane must still provide support if order to do so by the court. If a husband and wife have lived separately for 1 year without cohabitation, the court may grant the couple a decree of divorce.
