The court process has four steps:

  • Arraignment - You would be ordered to appear in court and this is when you find out what charges you are facing and you will give a plea. Then the second court date is scheduled and it is crucial to hire an attorney at this stage.
  • Pretrial Conference - You would attend the conference with your lawyer and the prosecutor will recommend a sentence to the judge in exchange for a guilty plea. You will be informed of the sentence and you can decide to plead guilty at this point or refuse and a trial date will be set.
  • Trial - The victim and any witnesses will have to testify in court and the prosecutor will present evidence and then you and your lawyer will present your testimony and evidence. The judge will decide if you are guilty or not guilty.
  • Sentencing - Depending on the judge's decision the sentence will reflect his or her ruling at the trial and can include a jail sentence, community service, fines, and even counseling.
