About Domestic Violence No-Contact Orders

Law enforcement agencies in Las Vegas and nationwide recognize that domestic violence is often a recurring event. Due to the fact that the abuser and the victim share a romantic relationship – and often have children and shared property – an incident of abuse is rarely a single, isolated event. Whether the parties reconcile only to experience a repeat blow-up in the future, or if the abuser continues to engage in stalking, harassment or trespassing against the victim, there are countless examples of situations where domestic violence takes place again and again, often with tragic results. For this reason, state law makes it possible for a victim of domestic violence to obtain a restraining order against the perpetrator.

There are several different types of protection orders available to domestic violence victims. An Emergency Protective Order can be obtained over the phone within 12 hours of an arrest for domestic violence. It lasts for up to one week, at which time you and the other party will be required to attend a hearing to determine whether the order should be lifted or extended. A Temporary Order for Protection can last for as long as 30 days, and it is available based on your testimony as to the danger you fear from the abuser. You can also apply for an Extended Order for Protection requires a hearing at which both you and your spouse or partner will have the opportunity to provide evidence and testimony, and it may last for as long as a full year.

Powers of a Domestic Violence Restraining Order

A domestic violence protection order can include a number of different provisions, including:

  • Prohibiting the other party from continuing to engage in any type of abuse against you or even from contacting you
  • Ordering the other party to vacate your home and continue to pay the rent or mortgage, regardless of whose name is on the lease or deed
  • Prohibiting the other party from coming near you, including staying away from your work, school or other places where you are likely to be found
  • Awarding you temporary or permanent child custody and child support, as well as requiring that any visitation with the children be supervised by a third party
  • Requiring the other party to sell or turn in any firearms to law enforcement, as well as prohibiting him or her from owning or possessing a gun for the duration of the order.
