Every item in a final divorce agreement is not permanent. Situations change, and certain articles in your divorce agreement might need to be adjusted. For example, a parent paying child support may lose their job, and are no longer able to make said payments. If this or any other event occurs in a person's life that warrants a change to a divorce agreement, they have the ability to petition the family court for a modification. Whether a person is seeking an upward or downward modification, a petition must be filed, and proof must be given by the person who is seeking the modification. Types of Modifications

Modifications can be made to child custody, visitation, spousal support, child support, or alimony agreements. If a man is paying spousal support to his ex-wife, and she gets a higher paying job, he may petition for a modification. If he loses his job, and cannot afford the spousal support that the court ordered, or cannot afford it at all, he also has grounds to petition for a downward modification. The same grounds for spousal support modifications can be used for child support, as well. If a woman is paying child support, and she received a raise, the ex-husband can file for an upward modification.

Child custody may also be modified after a divorced is finalized. A child may wish to live with the other parent, and said parent must petition the court to have the custody agreement reflect the child's wishes. Parents who wish to change custody, or increase/decrease visitations, they may also petition the court to have the visitation agreement changed. An ex-spouse may wish to move to a different state with their child. In order for this to be allowed, the court must determine if the move is in the child's best interests, and they must consider the relationship between the child and the non-moving parent.
